Change of Status

​非移民身份转换

Change of Non-Immigration Status:

 

Aliens may be allowed to change their non-immigration status upon 60 days entering the United States. A formal petition must be filed with the U.S. Immigration Services. Aliens do not need to leave the United States before receiving the final decision from the U.S. Immigration Services.

 

Change of Immigration Status: (I-485):

 

Aliens who have already had immigration petition filed on his or her behalf, and the priority date has become available, or  “current” , may file the  I-485 to adjust his or her status to that of a permanent resident of the United States. In addition, certain Aliens may be allowed to file the I-485 earlier( before the priority date) to get travel document and working permit according to the Chart B of the Immigration Visa Bulletin.

以非移民签证身份进入美国的外籍人士可根据个人情况选择转换或调整非移民签证身份 。但根据美国移民局的规定来讲， 以非移民身份进入美国的外籍人士在30天内是必须履行签证持有者进入美国的最初意图的。换句话说， 非移民身份持有者是不能在30天之内转换为其他非移民签证。 但在进入美国60天后， 非移民身份持有者可根据自身情况的改变选择转换非移民身份。 例如， B-1/B-2签证持有人在进入美国60天后可选择转换为F-1学生身份。 这就是我们所谓的30/60 规定。

需要在美国境内转换非移民身份的外籍人士需要向移民局提交正式申请材料并在批准后才可以以其他非移民身份合法居留在美国。 但是在非移民申请转换材料递交后，外籍人士可以在美国等待移民局结果。
